By downloading, installing, or using PhotoBye ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

PhotoBye is a photo management application that helps users organize and clean up their photo libraries through intelligent deletion features. The App provides:

• Random photo deletion based on user-defined parameters
• Recent photo deletion with customizable time periods
• Photo library analysis and statistics
• Deletion history tracking and reporting
• User preference management and settings

3. User Responsibilities

As a user of PhotoBye, you agree to:

• Use the App Responsibly: You are solely responsible for any photos deleted through the App. We strongly recommend backing up your photo library before using deletion features.
• Comply with Laws: You agree to use the App only for lawful purposes and in accordance with these Terms and applicable laws.
• Respect Intellectual Property: You agree not to use the App to delete photos that infringe on others' intellectual property rights.
• Maintain Account Security: You are responsible for maintaining the security of your device and preventing unauthorized access to the App.
• Provide Accurate Information: You agree to provide accurate and complete information when using the App.

4. Subscription and Payment Terms

PhotoBye offers both free and premium subscription options:

• Free Version: Basic photo deletion features with limited functionality
• Premium Subscription: Advanced features including unlimited deletions, detailed analytics, and priority support
• Payment Processing: All payments are processed through Apple's App Store payment system
• Subscription Renewal: Premium subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Cancellation: You can cancel your subscription at any time through your Apple ID settings
• Refunds: Refund requests are subject to Apple's App Store refund policies

5. Intellectual Property Rights

The App and its original content, features, and functionality are owned by PhotoBye Team and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

• App License: We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes
• Restrictions: You may not copy, modify, distribute, sell, or lease any part of the App
• User Content: You retain ownership of your photos and content. We do not claim any rights to your personal photos

6. Disclaimers and Limitations

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, PHOTOBYE TEAM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the App will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy, reliability, or completeness of any information provided by the App

Limitation of Liability: In no event shall PhotoBye Team be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or relating to the use of the App.

7. Data and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

• Photo Processing: All photo analysis and deletion operations are performed locally on your device
• Data Collection: We collect minimal data necessary for app functionality and improvement
• Third-Party Services: We may use third-party services for analytics and payment processing

8. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms.

• Effect of Termination: Upon termination, your right to use the App will cease immediately
• Data Retention: We may retain certain information as required by law or for legitimate business purposes
• Survival: Certain provisions of these Terms will survive termination

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

• Dispute Resolution: Any disputes arising from these Terms will be resolved through binding arbitration
• Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class action lawsuits
• Small Claims Court: Either party may bring claims in small claims court if the claim qualifies

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or by email. Your continued use of the App after changes become effective constitutes acceptance of the new Terms.
